The marriage between Lamar Odom and Khloe Kardashian is spiraling even more out of control.
In the early morning hours of Monday, the basketball star was spotted aimlessly roaming the dark streets of downtown LA after midnight, stopping at one point to buy a banana, then later taking photos with fans and then meeting friends. He didn't settle in at his bachelor apartment until 6:30 am.
Then later that day he was spotted saying 'Life is good' as he exited Teru Sushi in Studio City.
On Tuesday reports surfaced from RadarOnline that Mrs. Odom has been spying on the former Clipper for one year to gather evidence she can use against him in case she heads into a divorce.
Complicating his life even further, the same day a photographer filed papers in LA against Lamar for destroying $15,000 worth of camera equipment back in July when the athlete reportedly exploded after being questioned about the status of his marriage, reports TMZ.
Lamar has been in hiding ever since it was reported that he checked into then out of rehab in early September.
This Monday morning sighting is the first of its kind since then, though it was reported he stopped by Octopus, also in downtown LA (an hour drive from the Tarzana home he used to share with Khloe), on Friday.
Looking very thin and rather exhausted, the athlete spent much of his Monday morning alone walking in the dark. Dressed in a black Nike track suit with red-and-white Nike trainers, he was more aptly attired to hit a basketball court, not the streets.
He started his evening at restaurant chain Wokano, which serves both Japanese and Chinese food, but left after five minutes. He then bought a banana and ate it while walking down the street. He stopped by his apartment again for a short period and talked to fans, one pair was a mother and daughter team, in the lobby of his building. He even posed for photos with the admirers and seemed in good spirits.

On Monday night, just hours after his late-night saunter, he was spotted getting dinner at Teru Sushi in Studio City, a 45 minute drive from the apartment he's been staying at in downtown LA.
Dressed in the same black Nike tracksuit but looking like he was in a much better mood, the shooter, who was still wearing his wedding band, said, 'Life is good' as he stepped into the back seat of a waiting black SUV with a driver. The video can be found on TMZ.
When asked if he needed professional help he replied, 'No.'
After he was asked who he hopes to play basketball for next season he said, 'Anybody that's a fan.'
The most stunning response came when he was asked if he has spoken to Khloe. The player laughed and said, 'That's my wife,' acting as if it was obvious that he would be conversing with her because they are, after all, married.
Lamar's driver then took off into traffic.

RadarOnline is reporting that Khloe hired a private detective to gather proof of her husband's alleged infidelity because she wants to satisfy a clause in their prenuptial agreement that states the terms of their financial agreement will change if there is proof there was cheating.
Lamar, who is allegedly a regular user of crack cocaine, has been accused of having affairs with Polina Polonsky, Jennifer Richards and three other women who have yet to be named.
If the cover girl can prove he has been with other women, she could stand to gain a large lump sum of cash or hefty spousal support if they split.
Khloe, 29, has reportedly earned $18m while Lamar, 33, has made $56m.
A source told RadarOnline.com: 'Khloe has not only photographic proof that Lamar cheated on her with at least five different women, but has copies of text messages between Lamar and the other women.
'She is a very smart woman and knew she had to get the proof because of the infidelity clause in their prenup.'
The couple, that will have been married four years this month, are reportedly living separately after she kicked him out of their LA-area home for cheating on her.
Lamar's mistress Polina claimed he lived with her for six weeks in June and July during which time she also allegedly witnessed him using crack cocaine.
The Kardashians are no strangers to private detectives.
Kim Kardashian worked with an investigator during an episode of last season's Kim and Kourtney Take Miami.
Khloe has continued to wear her wedding rings which she showed off on Monday during a taping of her show Keeping Up With the Kardashians at the family's DASH clothing store in West Hollywood. The reality star was accompanied by sister Kourtney.
With nicely styled ombre hair, a black and white jumpsuit and an oversized blue Hermes Kelly bag, the 29-year-old didn't look distressed but looks can be deceiving.
